• B will be charged in addition to 'A' when A and B both are involved. Change for above deviation as in B up to 1% will not be taken.
• If any applicant completes the structure of a particular floor as per sanctioned plan and applies for deviation under Rule 25 no penalty will be levied.
• If any applicant applies for sanction U/s 25 immediately after commencement notice, no penalty will be charged.
• No W.T., WS, ST & SD. will be levied in case there is no extra generation of space u/R 25(2)(b)

Fees for Retention of unauthorized Structure U/s 400(1)

i) Fees for retention of unauthorized structure, under this section, for the respective category of use group of building shall be charged at 2.5 times of the normal fees for sanction including 2.5 times of the charge of WT, WS & ST as per respective Table Surcharge including Development fees for non-residential use group only and development fees for common passage for all types shall be charged single time of normal fees.

a) These fees are chargeable for the floor area, which is sanctionable as per prevailing Bldg. rule only.
b) The floor area beyond sanctioned limit as per Rule 61 (FAR) & 51 (Means of Access) of Bldg. Rules, 1990 if permitted shall have to be charged as 5 times of normal fees, if it is permitted under Section 400(1) or otherwise, except Govt. aided school and colleges where the charges will be decided by the MMIC (B).

ii) If the roof of the unauthorized construction is made of sloped roof with material like Asbestos, CGI Sheet or RT or similar shed for residential use only, the fees under the section will be equivalent to 1.25 times of the total sanction fee as per para (i) above. For other than residential building charges will be 2.5 times and 5 times of normal sanction fees as per respective use group. In such cases application of rate regarding Sl. No. 1(b) will be 2.5 times in respect of residential building of height 7.00 m.

iii) Rs. 500/- per Sqm. in case of residential & Rs. 1000/- per Sqm. in case of other than residential of ground coverage in excess of permissible limit as per Rule 62 & 71B of Bldg. Rules, 1990 if permissible U/S 400(1) read with 416 or otherwise will be levied.

• Effective area with the intention for partially covering with roof / floor by partially constructing columns, beams, slabs, stair etc. to be charged @ 80% of the retention fees & charges for such effective area as stated dealing u/s 400(1).
• In addition to the fees indicated in (i), (ii), (iii), Sketch fee shall be levied as noted below:
