are the key activities of the Department?
The key activities of the department are:
a. To extend sanction for erection of new building
b. To extend sanction to for extension/ remodeling/renovation of existing building
c. To stop unauthorised construction
d. To demolish unauthorised construction
e. To regularize the construction of unauthorized buildings on receipt of penalty
f. To prohibit demolition of heritage building
g. To preserve a copy of the sanctioned building plan and to deliver it to the
applicant on demand during any subsequent requirement.
h. To take reasonable
action against insecure buildings.
2. What activities do not require any permission
from KMC’s building department?
a. White washing or painting
b.
Plastering and patch work
c.
Repairing of a staircase or lift
d.
Re-flooring the surface of an existing
floor
e.
Reconstruction of an existing damaged roof without
changing the character and dimension of such roof
f.
Erection
of a false ceiling in any floor for air-conditioning or any decorative
purpose
g.
Providing for or closing off an internal door
or window or a ventilator so that the same does
not open directly opposite a door or window of
another building
h.
Replacing of fallen bricks, stones or
repairing damaged pillars or beams
i.
Replacing or renewing existing pluming
services
j.
Boundary wall upto a height of 3 meters on the
periphery of the premises
k.
Erection, re-erection, addition
to or alteration of –
l.
An internal partition wall,
which does not violate any of the provisions of the act.
m.
A
parapet wall or cornice or chajja within the boundaries
of the site and not overhanging a street such that the
total height of the parapet wall shall not be more than
1.5 meters and width of the cornice or chajja shall not
be more than 50 cms.
n.
Carrying out such other work as necessary
in the opinion of the municipal commissioner for reasons
to be recorded in writing to maintain the building
in good condition or to secure it from danger to
human life.
3. Do I need to take approval from KMC to
demolish my building?
No permission is required in case of non-heritage
buildings. However, a notice is to be given to the
municipal commissioner in this regard. You should
also ensure that the demolition work is carried out
under the supervision of an empanelled Structural
Engineer. But, in case of a heritage building permission
from heritage conservation committee is required.

4. What
activities require permission from KMC’s
building department?
Work that requires permission from KMC’s
building department includes the following,
a.
Erection
of a new building
b.
Addition or alteration of an existing
building
c.
Re-erection of any building where the structure
has been pulled down, burnt or destroyed.
d.
Change of use
of an existing building
e.
Reconstruction of an existing
roof
f.
Any structural change
g.
Removal or reconstruction of principal
staircase or alteration of its position
h.
Installation
of a new lift
i.
Permanent closure of any door or window
in any external window
5. What
consequences would I face if I undertake any
of the above construction activities without
obtaining sanction?
KMC is very serious about ensuring that each building in its jurisdiction is
constructed with appropriate authorization. In case of unauthorized construction,
KMC may lodge a complaint with the police who would in turn issue an arrest warrant.
KMC may also decide to demolish the building without granting any opportunity
for hearing.

7. Can
I construct any building with asbestos sheet
or similar material without sanction?
No, such construction is not allowed without approval from KMC.
8. Is
there any stipulation regarding building materials
that can be used?
There are no specific stipulations but the materials should be as per the I.S.Code.
9. What
floor area ratio (FAR) and ground coverage may
be consumed for a certain combination of plot size
and abutting road width?

10. What are the basic parameters used for calculation
of sanction fees in case of building plan?
The parameters used are:

Means of access and total covered area to calculate

11. What
departments/Institutions do I need to get an NOC
issued from? Why is such an NOC required?
You would require an NOC from the following departments:
a.
Kolkata Improvement
Trust (KIT): In order to check the alignment with respect to Kolkata Improvement
Trust.
b.
Survey Department: For alignment with road width
and to fix the floor area ratio (FAR) and also
the height.
c.
Kolkata Metropolitan Development Authority
(KMDA): In cases where the building location is within
500 meters of the central line of the E.M.Bypass
d.
Pollution:
In case of construction of more than 100 flats or 60,000
sq ft. area within one premise.

12. In
which cases is splaying of corner and gifting
of strip of land required?
Premises which lie at the junction of two streets and the road width there is
below 2.4 meters, then the citizen has to leave 1.5 meters from the central line
of the passage or road and then start construction.
13. Under
what cases the observation of the Municipal Building
Committee (MBC) is required prior to sanction?
Sanction
is required under the following cases:
a.
Land area
exceeding 500 Sqms.
b.
Building exceeding a height of 14.5
meters
c.
Corner plot having width of means of access more
than 10 meters
d.
Buildings other than for residential use
e.
Plot situated
within 500 m from flyover or bridge
14. Will there be any inspection by KMC during
execution?
Yes, KMC would undertake inspection of the site phase-wise as per the application
submitted by the LBS appointed by the owner or developer.
15. To
undertake construction work or repair work, I
need to stack up the building material on the
footpath. Do I need to take permission? If yes,
then from whom?
You need to take permission from the conservancy
department of KMC. You can contact either the
ward office or the borough office.
16. I
need to erect scaffolding on footpath or road.
Do I need to take permission?
You need to take permission from the conservancy department of KMC. You can contact
either the ward office or the borough office.
17. To
undertake construction work or repair work, I need water for plastering,
flooring and other repair/civil work. Do I need to take permission from
KMC for use of water?
Yes, you need to take permission from the water supply department of KMC. You
would be required to pay prescribed charges for the same.

18.
After issuance of building sanction plan
for how long can commencement / completion of construction
work wait ?
You need to start the construction of your building within 2 years of sanctioning
of building plan. The construction of building should be completed within 5 years
from the date of sanction of building plan.
19. If I have exceeded the time frame for commencement
of construction work, how can I extend the validity
period?
If the construction work does not commence within two years of issue of building
permit, extension of the validity period would not be allowed. You would be required
to apply afresh for the building sanction. However, the municipal commissioner
under special circumstances may decide to extend such validity period by deposition
of requisite fees and charges.
20.
If I have exceeded the time frame for
completion how can I extend the validity period?
In order to apply for such extension,
you need to submit the following documents:
a.
Application
letter giving reasons for seeking such extension
b.
Consolidated
rate bill (Current)
c.
Letter from concerned LBS/Architect
and ESE, certifying that the construction already done
is in conformity with the Building Permit. The objective
is to ensure structural stability
d.
Letter of Commencement
e.
Copy of the Sanctioned building
plan

21. Do
I need to submit any documents to KMC after the
completion of construction?
Yes, you are supposed to send a notice
of completion to KMC as per Annex
B. The following d
ocuments needs to be submitted along with the notice
of completion:
a.
Structural Stability certificate duly
certified by an Empanelled Structural Engineer or an
Architect or a Licensed Building Surveyor as applicable,
who has supervised the construction since commencement.
b.
Structural
Stability certificate for underground reservoir duly
authenticated by persons as in paragraph a) above in
case of buildings having more than three separate and
independent residential units and for all buildings other
than residential buildings.
c.
Photo copy of a set of valid
B.S. Plan along with all plans regularized U/S 400, 416
of CMC Act,1980 and U/Rule 25 of CMC Building Rules 90
with revalidation Plan U/S 399 of CMC Act, if any.
d.
NOC
from WB Fire service where height of building exceeds
14.5m or primary use group of the building is non-residential.
e.
Lift
license from Chief Electrical Inspector, Govt. of WB.
f.
Internal sewerage sanction plan (sanctioned by Drainage
Dept.)
g.
Such other certificates/documents/declarations
as are necessary under any law for the time being in
force or as the Mayor-in-Council may from time to time
specify in this behalf.
22. Can
I make any changes to the building after occupancy
certificate has been issued by the building department?
Yes, you can make the changes but
you need to apply to your borough executive engineer
to get necessary approval and a structural stability
certificate.
23. If
there is a building around in dilapidated condition
what action can I take as a citizen?
KMC encourages responsible citizens to provide information
regarding dilapidated buildings. Kindly inform DG
(Building) or Deputy Chief Engineer or Borough Executive
Engineer (Building). You may also call at the toll-free
helpline 1600 33 3375.
24. I
wish to buy a building. Can I procure a copy
of the sanction plan / occupancy Certificate?
Yes, you can procure a copy from the building department located at the headquarters
of KMC after depositing the requisite fee depending upon the size of the sanction
plan. If you currently do not own the building then, you would be required to
obtain permission from DG (Building) and pay the requisite fees.
